Terms of Service
Effective August 31, 2026
These Terms govern your use of PermacultureData.com, operated by Permaculture Data LLC, and its dashboards, databases, search tools, and related services (the “Service”). By creating an account or using the Service, you agree to them.
1. Accounts
Keep your account information accurate and your login credentials secure. You are responsible for activity under your account and must tell us promptly about suspected unauthorized access. You must be at least 18, or the age of legal majority where you live, to purchase a subscription.
2. Annual subscription and cancellation
Paid access is offered as an annual subscription. The price, taxes, renewal date, and any discount will be shown before you pay. Unless you cancel before renewal, you authorize us and our payment processor to charge the payment method on file once per year.
You may cancel at any time through your account or by contacting us. Cancellation stops the next renewal; access continues through the end of the paid term. Except where required by law or expressly stated otherwise, payments are non-refundable once a subscription term begins. We will give advance notice of material price or renewal changes.
3. Fair use
You may use the Service and its results for your own personal or professional design work, including client projects. You may not share account access, scrape or bulk-export the databases, resell the data or Service, bypass access controls, reverse engineer protected parts of the Service, introduce malicious code, or interfere with other users or our systems.
4. Ownership and your content
Permaculture Data owns the Service, brand, interface, original datasets, curation, and related intellectual property. Your subscription gives you a limited, revocable, non-transferable right to use the Service under these Terms; it does not transfer ownership.
You keep ownership of what you create. You also grant Permaculture Data a worldwide, perpetual, irrevocable, royalty-free licence to use, store, adapt, publish, and distribute any design content you submit — including guilds, plant relationships, placements, and corrections — and to incorporate it into the Service’s databases as a permanent part of the shared library. That licence survives closing your account, because contributions become part of a dataset other subscribers rely on and cannot be unpicked from it later.
In plain terms: build a guild here and it may become part of the guild database for everyone. You can still use your own work however you like, and we will not claim you did not create it. If you would rather a design stayed private, do not submit it to a shared or community area of the Service.
Photographs you upload remain yours. You grant Permaculture Data a worldwide, perpetual, royalty-free, sublicensable licence to store, review, crop, resize, adapt, publish, and use submitted photographs in the shared library and in materials that explain or promote the Service. You confirm that you took the photograph or otherwise hold the rights needed to grant this licence, and that it does not contain identifiable people or unlawfully disclosed information. We may reject or remove an image and are not required to publish it.
5. Design support—not professional advice
The Service organizes information and supports design decisions. It is not a substitute for site observation, local knowledge, or advice from qualified engineers, architects, builders, agronomists, medical professionals, or other licensed experts. Conditions vary. Verify plant safety, site data, structural requirements, utilities, permits, and local codes before acting.
6. Availability and warranties
We work to keep the Service useful, accurate, and secure, but data can be incomplete and services can be interrupted. To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
7. Limits of liability
To the fullest extent permitted by law, Permaculture Data will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, crops, data, or opportunity, or decisions made from Service content. Our total liability for claims relating to the Service will not exceed the amount you paid us during the 12 months before the event giving rise to the claim. Rights that cannot lawfully be limited remain unaffected.
8. Suspension, changes, and governing law
We may suspend or end access for material violations, fraud, security risks, or unlawful use. We may update these Terms as the Service changes. If a change materially affects your rights, we will provide reasonable notice; continued use after the effective date means you accept the revised Terms.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except where the consumer laws where you live require otherwise. If one provision is unenforceable, the rest remain in effect.
